I, the undersigned, agree to the terms of this Acknowledgment, Waiver, and Release of Liability (this “Waiver”) in consideration for and a prerequisite to voluntarily attending the on-site education organized, operated, or hosted by PUENTE Learning Center or their directors, officers, teachers, employees, agents, or representatives (“PUENTE”).
I understand that this Waiver must be read and understood by me before I am permitted to enter the PUENTE premises, I acknowledge and agree, to all of the following conditions:
1. I understand and acknowledge that my attendance at and participation in class is completely voluntary.
2. I understand and acknowledge that contact and interaction with others increases the chance of contracting COVID-19, and attending an Activity means a greater risk of potential exposure to COVID-19;
3. I acknowledge that I are aware and fully understand that being exposed to, and/or infected with, COVID-19 can be hazardous, and that it is possible to sustain serious injury, physical disability, death, and/or loss as a result;
4. I will not attend class if I or someone who I have had close contact with has displayed any symptoms identified as associated with COVID-19 within a 72 hour period prior to an Activity;
5. I will not attend class if I or someone with whom I have had close contact has been diagnosed with COVID-19 until such time as COVID-19 tests are negative and proper health clearance has been provided, including the requisite self-quarantine or self isolation period has been completed;
6. I will wear a face covering and engage in social distancing to the greatest extent possible at all feasible times during class;
7. I will promptly notify PUENTE via phone or email if I am diagnosed with COVID-19 within seven (7) days following an Activity, and I authorize PUENTE to comply with any and all local, state, and federal disclosure requirements, which may include disclosure of my name and contact information as a result;
8. I understand PUENTE may ask me/us to leave if I do not comply with any of these agreed-to conditions;
9. I voluntarily assume and accept any and all risks of loss, injury, or damage to myself, ourselves, or anyone else, including any family members with whom I live or come into contact, or my/our property, that may arise from, or is related in any way to, my/our voluntary participation in class, especially since I recognize the risk and such risk is known to me/us;
I AGREE TO FOREVER RELEASE, WAIVE, HOLD HARMLESS, DISCHARGE, AND COVENANT NOT TO SUE PUENTE LEARNING CENTER OR ANY OF ITS AFFILIATES, OR THEIR DIRECTORS, OFFICERS, TEACHERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER, DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED DUE TO ACQUIRING COVID-19, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES, OR OTHERWISE, WHILE OR OTHERWISE AS A RESULT OF PARTICIPATING IN ANY ACTIVITY.
I acknowledge and represent that I have read the terms of this Waiver, I understand it, I will abide by the terms hereof, and I am signing it voluntarily. I further acknowledge that I am fully informed about the risks involved in attending class; no oral representations, statements, or inducements, apart from the foregoing Waiver, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Waiver for full, adequate, and complete consideration fully intending to be bound by the same.
